Our client was a business woman working in an area of the City of Pittsburgh new to her. On one of her first days commuting to her work place she was cited for illegally Meeting / Overtaking a School Bus with its red lights flashing and arm extended. This is a serious violation as a school bus violation under this section requires a 60 day suspension of your driver’s license if convicted. She was a conscientious and careful driver normally. We felt that a defense to the citation for passing the school bus existed because the school bus was not stopped “at an intersection” as the statute requires. Our client reported that the school bus was stopped a considerable distance back on the intersecting street when she drove through the intersection. The Court considered our information and a compromise decision was reached on an amended charge that carried no points and no loss of driving privilege.
